I was scammed by fear666. He later returned the money because he didn't like seeing his reputation blow up into flames over $5 (lmfao..)

So, he gets a 1 day ban? What kind of example does that set for other users? By doing this are you saying that any user can knowingly lie to users to "hold onto" their money for 12 hours, or however long they want?

Can you explain this to me?

Jacob needed to here his side as well. Also, he returned your money. He gave it back so there was not any need of banning but I guess the 1 day ban was for attempting a scam

I have to agree. Attempted scamming should warrant a ban, or a ban from selling/buying at the very least.
